Pensions inheritance tax 2027 rules prompt UK families to rethink bonds and trusts
"Next year's pensions changes have forced me to rethink my sons' inheritance," a father tells the Telegraph in a case study published on 13 October 2026. The change prompting his rethink does not actually take effect for more than five months after the article appeared, on 6 April 2027, but the planning has already begun.
From that date, most unused pension funds and pension death benefits will be swept into the value of a deceased person's estate for inheritance tax purposes, according to Wesleyan Financial Services, reported by dentistry.co.uk. Pots that currently sit outside the estate, often left untouched while other assets are spent down, will instead be taxed alongside everything else at death.
For families relying on life policies and trusts as part of succession planning, that forces a rethink of the order in which pensions, ISAs, offshore bonds and trust-held cover get drawn down or gifted. PPLI.com's research on pensions and inheritance tax from April 2027 notes that "for wealthy families this ends the habit of spending everything else first and leaving the pension untouched."
The administrative burden falls on personal representatives rather than pension schemes. Wesleyan Financial Services states that "the deceased's personal representatives will be responsible for reporting and paying any IHT due on pension wealth," and that they "can ask the pension scheme to temporarily withhold up to 50% of certain pension benefits while the tax position is worked out." Pension benefits passing to a spouse or civil partner remain covered by the existing exemption, the firm confirms.
Farming and rural families face similar pressure on succession planning. Yahoo News UK reports that the April 2027 change "will alter how many rural families approach the transfer of assets between generations."

Describe your question →PPLI.com's analysis concludes that the response will rarely come down to a single product. "Most of the replanning will come from gifting, the order in which assets are spent, and trusts," the research states. "A policy is part of the answer for only some of them." Where a life policy is used, writing it into trust from the outset keeps the payout outside the estate and outside probate, separate from whatever pension wealth now falls within it.
The Finance Act 2026, which received Royal Assent on 18 March 2026, sets out the mechanics in sections 66 to 71, covering the charge itself, liability, withholding by scheme administrators and the related income tax changes. Deaths on or after 6 April 2027 fall within the new rules; deaths before that date are unaffected. The nil rate band of £325,000 and the residence nil rate band of up to £175,000 remain frozen until 5 April 2031, so pension wealth added to the estate from next April will in most cases simply eat into a threshold that is not moving.
