Serious violation of financial market law: AML failures in client relationships linked to a businessman accused of tax evasion
FINMA found that Mirabaud & Cie SA breached AML obligations and seriously violated financial market law by failing to review and document the economic background of relationships linked to a businessman accused of tax evasion, with weak governance and controls. It confiscated CHF 12.7 million, barred new high money-laundering-risk clients until compliance is restored, ordered a full client review and re-documentation of 2018 to 2022 high-risk transactions, and appointed an audit mandatary. The ruling has been legally binding since August 2023 and was not contested; the bank's challenge to FINMA publishing the case was dismissed by the Federal Supreme Court.
