Revenue Ruling 2003-91 reaches its conclusion on specified facts, not on a promise that every policy makes every return tax-free. Investment losses and policy charges still affect value.

Pay benefits: qualifying death proceeds are generally excluded from gross income under IRC section 101, subject to exceptions. Estate inclusion is a separate question under section 2042, including executor proceeds and incidents of ownership. Certain recent transfers may be covered by section 2035. Trust ownership alone does not establish estate-tax exclusion.

Access during life: loans, withdrawals, surrender and lapse need a separate tax and funding model. IRC section 72 and section 7702A distinguish modified endowment contracts from other policies. MEC distributions are generally income-first, and loans can be treated as distributions. Loans on other policies still create interest, reduce available value and can cause tax consequences on lapse with gain.

Who qualifies for PPLI insurance?

The accredited investor rules and qualified purchaser definition are separate. The natural-person qualified-purchaser test generally requires at least $5 million in defined investments; that is not a minimum premium. Investment Company Act sections 3(c)(1) and 3(c)(7) provide different exclusions. Determine the actual offering and applicable look-through requirements rather than assuming every holder must satisfy both tests. Carrier underwriting and PPLI suitability require additional assessment. Obtain written eligibility and subscription terms; do not assume every contract or charge is individually negotiable.

How to assess an issuing jurisdiction

The jurisdiction review begins with the issuing legal entity, insurance law and the owner’s relevant countries. For a US proposal involving Connecticut, South Carolina or Delaware, or a proposal involving Liechtenstein, Switzerland, Singapore, Luxembourg, Bermuda or the Cayman Islands, verify the actual carrier’s permission and the proposed contract. Foreign bank accounts: a bank account and an insurance policy are different legal arrangements. Account location alone does not create a tax exemption. Insurance is not a way to dispense with applicable reporting.
