Regulator and licensing lawFederal Act on Banks and Savings Banks (Banking Act, BA/BankG, SR 952.0). FINMA: 'Any business that involves accepting deposits from the public on a professional basis' requires a banking licence; foreign banks employing staff in Switzerland need a branch licence.  Source
Deposit protectionSwiss depositor protection (privileged deposits under Banking Act Art. 37a and self-regulatory deposit insurance under Arts. 37h to 37k), run by esisuisse (Einlagensicherung der Schweizer Banken und Wertpapierhäuser). Cover: CHF 100,000 per client per bank (privileged as second-class claims in bankruptcy, Art. 37a para. 1 BankG). Currency: CHF; foreign-currency deposits covered, converted at the exchange rate when bankruptcy proceedings start, generally paid in CHF. What is covered: Client balances on accounts at banks, private and corporate clients; clients resident or domiciled abroad are covered; deposits at foreign banks are covered if booked with a FINMA-authorised Swiss branch. Bonds and book-entry securities are not covered (they are segregated instead). All banks with a branch in Switzerland must be members.  Source
Custody assets in insolvencyBanking Act Art. 37d: custody assets under Art. 16 BankG are segregated in the bank's bankruptcy in accordance with Arts. 17 and 18 of the Federal Intermediated Securities Act (Bucheffektengesetz). esisuisse: securities in a custody account are the client's property and are issued to the client in bankruptcy, so they are outside deposit insurance.  Source
