Singapore or Luxembourg: where an Indian family’s policy should be issued

An NRI in Dubai has two proposals on the desk: a Singapore insurer and a Luxembourg one. Indian law treats them identically. FEMA regulation 4(ii) lets him keep either after he moves home, section 10(10D) taxes either the same way, and both countries report to the CBDT under CRS. The difference is in the law that protects the policy if the insurer fails, the way beneficiaries are named, the currency, the manager menu, and which other country the family may one day live in. This page compares the two on the points that decide, and names the two cases where neither is the right answer.

Indian, Singapore and Luxembourg law as at 20 October 2026, for an individual policyholder. Statements marked practitioner analysis rest on professional summaries rather than the statute. PPLI.com has no licensed partner in either country and names no insurer.

PPLI.com is a research publisher. It is not an insurer or an insurance intermediary, it is not registered with IRDAI, MAS, the CAA or SEBI, and it does not solicit or arrange insurance in India or elsewhere. Nothing on this page is an offer of insurance.

What India does not care about

For Indian law, the two are the same policy

Nothing in the Indian rules turns on whether the insurer sits in Singapore or Luxembourg. A resident needs the RBI’s permission for a new foreign policy under regulation 4 of the FEMA Insurance Regulations, from either; a policy taken while non-resident may be kept after return under regulation 4(ii), from either. At PPLI scale the premium is above ₹5 lakh, so a surrender in life is taxed at slab rate on the gain and the death benefit is exempt, from either. Both countries operate CRS and report a resident Indian policyholder to the CBDT, and the policy goes in surrender value.">Schedule FA every year, from either. India has a tax treaty with both. The Indian side is on the four Indian rules; this page is about the other side.

The decision

Which one, for whom

Singapore, when the family lives in Asia and thinks in dollars

For an NRI in Singapore itself, a Singapore-law policy from a licensed insurer is the natural choice: the statutory nomination is available, the regulator is local, and the time zone and the service are the family’s own. For an NRI in Dubai or Hong Kong planning an eventual return to India, Singapore offers a USD contract, a treaty with India, a large Indian professional community among the advisers, and a regulator the family’s CA in Mumbai will have heard of. The weak point is the protection scheme, which caps guaranteed benefits at levels that mean little to a large investment-linked policy; the real protection is the segregation of the separate account, which should be read in the contract. Our Singapore edition goes through the return route in detail: returning to India from Singapore with a foreign life policy.

Luxembourg, when the family has a European member or wants the strongest segregation

Luxembourg’s super-privilege is a statute, not a contract term: article 118 ranks the policyholder first on the assets representing the technical provisions, and the custodian bank holds those assets under an agreement the CAA supervises. For a family that wants that in the law rather than in the brochure, or that has a daughter in Paris or a son in Frankfurt whose own country will one day tax the policy, Luxembourg is the centre built for the purpose, and its internal dedicated funds accept almost any manager the family brings. The costs are a EUR default that an Indian family has to think about, a European time zone, and a client-category regime in which the assets a policy may hold depend on the premium and the policyholder’s wealth.

Neither, in two cases

If a member of the family is a US person, the policy has to satisfy IRC section 7702 and the diversification rules of section 817(h), and the insurers that write such contracts are mostly in Bermuda and the Cayman Islands; a Singapore or Luxembourg policy that does not meet the US definition is taxed in the US as if the assets were held directly, with PFIC consequences. And if the family is resident in India with no NRI member and no permission under regulation 4, the question of where the insurer sits does not arise, because the policy cannot lawfully be taken; the realistic routes are on FEMA, LRS and foreign life insurance, and the GIFT City alternative on GIFT City life insurance.

Common questions

Questions Indian families ask about the two centres

Does Indian tax differ between a Singapore and a Luxembourg policy?
No. The FEMA permission rule, the ULIP) or Rs 5 lakh (other policies) of annual premium; death benefits stay exempt.">section 10(10D) ceilings, the slab-rate tax on a surrender, the exempt death benefit and Schedule FA apply the same way to both. India has a tax treaty with each, and both report under CRS.
Which gives better protection if the insurer fails?
Luxembourg’s protection is statutory: article 118 of the law of 7 December 2015 gives policyholders a first-ranking claim on the assets held for them, kept with a CAA-approved custodian. Singapore relies on the insurance-fund rules and separate-account structure, with a protection scheme whose caps do not reach investment-linked values. Read the segregation terms of the actual contract in either case.
Can I nominate my wife and children on a Singapore policy?
On a policy governed by Singapore law and issued by a licensed insurer, yes: a trust nomination under section 132 of the Insurance Act 1966 in favour of a spouse or children keeps the proceeds outside the estate; a revocable nomination under section 133 does not give that protection. A Luxembourg policy uses a beneficiary clause under its own law instead.
Which currency should the policy be in?
The currency the family will spend in. An NRI returning to India with children studying abroad often keeps USD; a family with a European future may prefer EUR. Singapore contracts default to USD or SGD, Luxembourg to EUR, and both offer other currencies at the large end.
What if one of us is a US citizen or green-card holder?
Then the policy must meet IRC section 7702 and section 817(h), with no investor control, or it is taxed in the US as if the assets were held directly. The insurers that write such contracts are mostly in Bermuda and the Cayman Islands. Start with a US adviser.
Does PPLI.com recommend an insurer?
No. PPLI.com has no licensed partner in Singapore or Luxembourg and names no insurer. Check any firm on the MAS Financial Institutions Directory or the CAA’s register, and take advice from a licensed intermediary and your own lawyer.
